FIRST Security Holidays Act Remediation
Like many public and private organisations across New Zealand, FIRST Security is carrying out a review into the provision of holiday pay entitlements for current and former waged employees
The Holidays Act 2003 is complex and uses different rules and calculations for different types of leave. As a result, many organisations have been asked to review how they have applied these rules to confirm whether employees received their correct entitlements.
This review is intended to confirm that employees received their correct entitlements under the Holidays Act 2003 and to correct any historical calculation errors.
This process is also called a "Holidays Act remediation." Below are some frequently asked questions that you may wish to review.
Who does this review relate to?
This review relates to holiday pay entitlements for:
- waged employees
- who worked for FIRST Security
- between 16 October 2019 and 15 October 2025.
The review does not relate to any time before or after this time period. It also does not apply to salaried employees.
What period is covered by the remediation and why?
Between 16 October 2019 and 15 October 2025.
Why?:
Start date: We are legally obligated to go back six years from the point of issue identification. We received the final technical report identifying these issues on 15 October 2025.
Why is this happening?
This matter relates to holiday pay entitlements under the Holidays Act 2003.
The Holidays Act is complex and includes different rules and calculations for different types of leave. This is a widespread issue affecting many employers in New Zealand and is not unique to FIRST Security.
What is the review process?
FIRST Security has engaged a third-party provider, Fusion5, to assist with this review. Fusion5 is reviewing all FIRST Security’s data and recalculating entitlements for the relevant period. Fusion5 will then check their calculations against what has already been paid to those waged employees.
Verification checks on a sample of the recalculations will also be completed by a third party to confirm the approach and results are correct.
Once these verification steps are complete, FIRST Security will advise you of the outcome of the review.
How will I know if I'm entitled to a payment?
If you are affected, we will contact you directly and advise you if any pay or leave adjustment is to be processed. Close to 50% of current waged employees will not receive a remediation payment and were paid leave correctly across the remediation period. We are contacting all potential affected colleagues, both current and former.
What do I need to do to get my payment?
If you are a former waged employee of FIRST Security who was employed between 16 October 2019 and 15 October 2025 and you would like us to check your holiday pay entitlements during this period, please complete the form below by 15 October 2026.
Current employees do not need to register as they will be automatically reviewed.
Why are you asking me for all this information?
We require certain information to verify your identity and include you in our review.
When will I receive my payment?
Once you have registered to have your holiday pay entitlements checked, we will work with our third-party provider to confirm your entitlements. After this has happened, verification checks will be completed before finalising outcomes.
We will then need to contact you to confirm your current NZ bank account details for payment.
This means you won’t receive any payment immediately. The timeframe will depend on factors such as the volume and complexity of historical payroll records, completing verification checks, and confirming your current bank account details.
How much will I receive?
Everyone will be different. Colleagues’ working hours and leave patterns are unique so every case must be assessed individually.
You will be advised what you are owed when we contact you directly. This will be a gross amount and taxed in accordance with IRD tax rates and subject to KiwiSaver deductions, if you are a member and not on a contributions holiday.
Will I be paid interest on the payment?
No, you are not entitled to interest.
Will I need to repay any overpayments that I have received?
No, FIRST Security is not requiring you to repay any overpayments - we are doing this in a way that benefits all FIRST Security colleagues, current and former.
